These terms apply to the Lotstamp app ("the app") published by Delix Pty Ltd ("Delix", "we", "us"), available for Android (and iOS where offered). By installing or using the app, you agree to these terms. If you don't agree, please don't use the app.
We give you a personal, non-exclusive, non-transferable licence to install and use the app on devices you own or control, for personal or business purposes, as permitted by the rules of the app store you got it from (such as Google Play or the Apple App Store). You must not copy, resell, reverse-engineer or redistribute the app, except where the law allows it.
Photos, videos, notes, logos and reports you create with the app are yours. They're stored on your device (see our Privacy Policy: https://delix.com.au/lotstamp/privacy/). You're responsible for backing them up. We can't recover content that's lost or deleted.
You agree to use the app lawfully. In particular, you're responsible for:
The date, time, GPS position, altitude, compass direction and street address come from your phone's clock and sensors and from third-party address services. They can be inaccurate or unavailable (for example indoors, near tall structures, or offline), and you can edit stamp details. The app isn't a survey instrument, and its stamps aren't independent certification of when or where a photo was taken. The concrete-crack filter and markup tools are visual aids only, not an engineering assessment. Check anything important independently.
Street addresses are looked up using OpenStreetMap Nominatim (map data © OpenStreetMap contributors, available under the Open Database Licence: https://www.openstreetmap.org/copyright), BigDataCloud, or your device's built-in geocoding service, and report map images come from OpenStreetMap's tile servers. These services are provided by third parties, may change or stop, and are governed by their own terms.
Lotstamp is free to download and use. Some features need a Lotstamp Pro subscription, sold through Google Play as a monthly or yearly plan at the price shown in the app before you buy. Subscriptions renew automatically until you cancel. You can cancel at any time in Google Play; cancelling stops the next renewal, and Pro stays on until the end of the period you've paid for. Payments, renewals and refunds are handled by Google Play under its terms and policies, and nothing here limits your rights under the Australian Consumer Law. We may change subscription prices for future billing periods; Google Play will tell you before a price change applies to you. We may update, change or withdraw the app or any feature at any time.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other law that can't lawfully be excluded.
Subject to section 7, the app is provided "as is" and "as available", without warranties of any kind. To the extent the law allows, Delix isn't liable for any indirect or consequential loss, or for loss of data, profit, or business, arising from your use of the app or of stamps, photos or reports created with it. Where our liability can't be excluded but can be limited, it's limited (at our option) to supplying the app again or paying the cost of having it supplied again.
You can stop using the app at any time by uninstalling it. Note that this doesn't delete files you saved outside the app (for example to shared folders). We may suspend the licence if you breach these terms.
The terms of the app store you downloaded the app from also apply to your use of it. If you use the app on an Apple device: these terms are between you and Delix only, not Apple; Apple isn't responsible for the app or its content, has no obligation to provide maintenance or support for it, and isn't responsible for any claims relating to it; Apple's standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies to your use of the app; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
These terms are governed by the laws of New South Wales, Australia, and you submit to the courts of New South Wales.
We may update these terms. We'll change the effective date, and continuing to use the app means you accept the updated terms.
